Salary Doesn't Mean You Are Exempt from Overtime Laws
If you are classified as an exempt employee, it means that your job responsibilities entitle your employer to deny your overtime benefits. It doesn't mean, however, that your employer has a right to violate your rights to an accurate classification.
Employers have a strict set of criteria they must apply in order to classify a job as exempt from federal overtime and other wage-and-hour laws. In order to classify a worker or supervisor as an employee exempt from overtime and meal & rest break laws, the following typically must all apply:
- Independent control of your work;
- Non-manual office work;
- Decisions and input directly affecting operations or management policies of your employer; and,
- Actual control over department staff and budget
